Terms & Conditions

By placing and order through PetsWillPlay you agree to the following terms and conditions of trade:-

1 General

1.1 These terms constitute a legal document (“the agreement”) which sets out the rights and obligations you as purchaser (“you”) and those of PetsWillPlay (“we” or “us”) in relation to services and products offered by us.
1.2 PetsWillPlay is based in England. Unless otherwise specified the product referred to are for use in the United Kingdom, We make no representation that products available are suitable for use outside of United Kingdom.
1.3 You and we submit to the exclusive jurisdiction of the English courts in relation to any disputes arising out of this agreement.
1.4 As per the Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999 your statutory rights are not affected under these terms and conditions.
1.5 We shall not be held libel for any breach of this agreement by circumstances caused by, including but not limited to, Acts of God, fire, lightning, flood or extremely sever weather, explosion, war, disorder, industrial disputes (whether or not involving our employees), acts or omissions of internet service providers or acts of local or central governments or other competent authorities.

2 Orders

2.1 We shall not be deemed to have accepted your order for products unless it has been confirmed.
2.2 From time to time we may have to make changes to the advertised product to:-
2.2.1 Ensure it conforms with any applicable safety or other statutory requirements or
2.2.2 To reflect changes in manufacturers specifications.
2.3 We will agree the price of products as per our order confirmation to you. These shall reflect out current quoted or published prices.
2.4 The cost of delivery may be at additional cost to the products quoted or published on our current price list.
2.5 The cost of fitting or installing equipment is only included if specifically agreed in writing by you and us.
2.6 We keep a very large stock of products. In the unlikely event that a listed product is out of stock, we will advise you and
2.6.1 Give you a realistic assessment of when the item will be dispatched
2.6.2 Offer you a chance of alternative suitable product or
2.6.3 Offer a refund (if already paid for the product).
2.7 Payment of products will be taken prior to dispatch.

3 Terms of Payment

3.1 Subject to any specially agreed terms in writing between you and us, we shall be entitled to invoice you and collect payment prior to the dispatch of products.
3.2 If you fail to make any payments on the date due, without prejudice to any other right or remedy we have, we can:-
3.2.1 Cancel this agreement between you and us
3.2.2 Suspend any further deliveries to you and/or
3.2.3 Charge you interest (both before and after any judgement) on the unpaid amount of 2% above the base lending rate of Barclays Bank Plc. as published from time to time. Interest is charged on a per annum basis, calculated daily.

4 Right to cancel

4.1 Under the Consumer Protection (Distance Selling) Regulations you have the right to cancel an order and return the products to us, subject to the following conditions:-
4.1.1 We must be informed by you in writing of the cancellation within 7 calendar days from receipt of the product
4.1.2 Where services are to be provided we will only accept cancellation if, within 7 days, we have received written notification to cancel AND the service hasn’t commenced
4.1.3 The products must be unused and returned in the original condition and original undamaged packaging
4.1.4 You have to pay the cost of returning the products to us
4.1.5 We can only refund the cost of the products. Postal costs incurred by us to deliver the products to you will not be refunded
4.1.6 Where delivery was “free”, 15% of the product purchase price will be deducted from our refund to you to cover our postal costs
4.1.7 Certain types of goods are not covered under these regulations such as books, DVD’s, custom made or customer specification goods, perishables and livestock
4.1.8 You will have to return the products within 7 days from the date of cancellation
4.1.9 If a product is not in a re-saleable condition then we will not be able to offer you a refund. We will send the product back to you and you will have to incur the cost of any return delivery
4.1.10 If the goods are damaged in transit we reserve the right to refuse a refund and it will be your responsibility to seek compensation from the carrier
4.1.11 Once we have received the product and satisfied ourselves that you complied with the above conditions we will make an immediate refund.

5 Warranties & Replacements

5.1 Subject to the clauses below, products offered by us, where new, are sold with the benefit of and subject to the manufacturers terms applicable to warranty and guarantees.
5.2 No liability is accepted for:-
5.2.1 Any default resulting from fair wear and tear
5.2.2 Accidental or wilful damage
5.2.3 Negligence
5.2.4 Failure to follow manufacturers instructions
5.2.5 Misuse, alteration or repair of the product without manufacturer approval.
5.3 There shall be no liability under any such warranty or guarantee if the total price for the product has not been paid.
5.4 Subject to clauses 5.1 and 5.5, if a valid warranty claim is made, we will replace or repair at our discretion the product free of charge. After the warranty period we may make a charge for either of these remedies.
5.5 We shall (at our or the manufacturers option) have the right to fulfil our obligations under clause 5.4 by refunding you the price you paid (or a proportionate part thereof, depending on age and condition). That will be the extent of our liability to you.
5.6 Items found to be damaged on delivery must be reported within 24 hours of receipt. Damaged goods will need to be returned to us before a replacement is dispatched.
5.7 Products returned subject to clause 5.6 must be sent back via standard Royal Mail or Parcel Force and then full postage charges will be reimbursed once the product has been received by us.
5.8 Clauses 5.6 and 5.7 do not apply to Aquariums, Tanks and Associated Stands. We regret to advise that once you have accepted delivery of these goods we can not offer any refunds.

6 Website Content

6.1 We have taken all reasonable care in the preparation of the content of our website. However, PetsWillPlay, to the extent permitted by applicable law, disclaims all warranties (express or implied) as to the accuracy of the information contained in any of the materials on this site.
6.2 We shall not be liable to any person for loss or damage arising from the use of any of the information or material contained on our website.
6.3 Certain links on our website will lead to other websites. We have no control over these sites and will not accept responsibility of liability for the material on any site which is not under our control

7 Limitation of Liability

7.1 Nothing in this agreement shall affect you statutory rights.
7.2 We do not exclude or limit liability if you are injured or due as a result of our negligence or for fraud and fraudulent misrepresentation. Nothing in this clause 7.2 shall exclude or restrict our liability, which cannot exclude or restrict by law.
7.3 Any liability we have other than for personal death or injury or for fraud or fraudulent misrepresentation (including any because of our negligence) is limited to the amount paid by you to us for the product.
7.4 Other than for personal death or injury, we shall not be liable to you under, or in connection with these terms and conditions, whether or not as a result of our negligence in contract, tort, pre-contract or other representing or otherwise for any indirect or consequential loss, loss of business, profits or savings you expected to make.

8 Indemnity

8.1 Save to the extent that it falls within the provisions of the above clause, you shall indemnify us and any third party (including its sub-contractors) from and against any liability, loss of profits, business interruption, consequential loss, pecuniary loss, claims or legal proceedings, including but not limited to, claims including defamation of intellectual property infringement, and expenses including legal fees, arising from your use of PetsWillPlay website or purchase of products or services from us which are brought or threatened against us or suffered or incurred by us by another person or entity.

9 Delivery

9.1 We aim to deliver within 7 days.
9.2 We deliver only to the United Kingdom.
9.3 You are liable for any re-delivery costs involved when you have not been available to receive delivery or have not collected or arranged re-delivery of a product from your local delivery depot.

10 Your Personal Data & Privacy Policy

10.1 We respect your personal information and undertake to comply with applicable Data Protection legislation in place from time to time.
10.2 We may hold information that you provide to us (such as on an order or registration form). This information may hold your name, address, telephone number, email address and how you manage your account with us. We may share your information with our sister company Fish-Fish-Fish.
10.3 We do not retain credit or debit card details.
10.4 Our website is supported by SSL (Secure Socket Layering).
10.5 Our service partners are fully compliant with the PCI DSS (Payment Card Industry Data Security Standard) requirements.
